Chief justice refers ethics complaints against Kavanaugh to 10th Circuit

US Supreme Court Associate Justice Brett Kavanaugh being sworn in on 8 October.

On Oct. 6, Kavanagh was confirmed to the court by a vote of 50-48 in the Senate, a slim victory after multiple women had accused him of sexual misconduct.

Roberts' letter did not identify Kavanaugh as the subject of the complaints, but Judge Karen LeCraft Henderson of the U.S. Court of Appeals for the D.C. Circuit revealed complaints against Kavanaugh in a statement on Saturday.

Henderson said in a press release earlier this month that the misconduct claims were filed after Kavanaugh's confirmation hearings, which began on September 4.

Even before the confirmation, Kavanaugh's opponents had a comeback line, printed on the back of jackets they wore to the Capitol: "November is coming".

Roberts' letter was sent to Judge Timothy Tymkovich, the 10th Circuit's chief judge. They only "seek investigations. of the public statements he has made as a nominee to the Supreme Court", Henderson said in a statement. Henderson took over from Chief Judge Merrick Garland, who recused himself from the matter. He did not immediately move to refer the filings to another appeals court.

McConnell described protesters "literally storming the steps of the Capitol and the Supreme Court", confronting Republicans at restaurants and shouting from the Senate visitors' galleries during last week's debate and vote on Kavanaugh.

Each federal court has a so-called "judicial council" to investigate conduct complaints and make disciplinary recommendations. Any member of the public can file a misconduct claim against a judge on the circuit where he sits, she noted. Details of the complaints have not been made public. The chief judge of the 9th Circuit asked Roberts to transfer the case for review after The Washington Post reported allegations against Kozinski.
