Judge Threatens to Hold Jeff Sessions in Contempt for Deportation

An angry federal judge ordered a plane carrying a mother and her daughter to turn around and head back to United States, hours after being whisked away by US authorities before a court hearing on their deportation status could be finished.

U.S. District Judge Emmet G. Sullivan of Washington learned in court that the two plaintiffs in a lawsuit before him were being removed from the United States and confirmed later that they were on a plane headed to Central America.

The ACLU asked for a delay on deportation for Carmen and her daughter, as well as 10 other people included the lawsuit who were denied asylum.

Sullivan said he would hold Attorney General Jeff Sessions, and Homeland Security officials in contempt for the deportation if they did not comply with his demand.

The lawsuit challenges Attorney General Jeff Sessions decision to exclude domestic and gang violence as reasons for immigrants to be granted asylum.

During a brief recess, she told her colleagues the pair had been taken from a family detention center in Dilley, Tex., to the airport in San Antonio for a morning flight.

According to U.S. Immigration and Customs Enforcement (ICE), Sullivan's order meant the taxpayer wound up paying for a needless round-trip flight.

In court on Thursday, Sullivan also temporarily blocked the United States from deporting plaintiffs in the lawsuit, most of whom are women fleeing sexual abuse and gang violence.

But lead ACLU attorney Jennifer Chang Newell, who was participating in the court hearing via phone from her office in California, received an email during the hearing that said the mother and daughter were being deported. Several coworkers at the factory where Carmen worked had been murdered, and her husband is also abusive, the records state.

A Department of Homeland Security official said the agency was complying with the court's order, according to NBC News.

A "credible fear" interview is a threshold screening that determines whether there is a "significant possibility" that an immigrant could show they are eligible for asylum in a full hearing with evidence, witnesses, and appeals.

The ACLU lawsuit, Grace v. Sessions, was filed Tuesday in federal court in Washington, D.C. The suit contends the new policies clash with protections created by Congress that establish an initial "credible fear" interview for asylum seekers.

Sessions and other Trump appointees have dramatically shifted how the federal government speaks about asylum, going as far as to suggest in public communications the unproven claim that asylum is a routinely abused legal loophole.

Two of the children and their mothers were deported before the suit was filed; the rest were being detained in Texas and NY. The reforms are already working to reduce the previously skyrocketing number of illegal aliens claiming to be "asylum seekers" after being caught by Border Patrol, but they have sent the open-borders left into a rage.
