Texas sanctuary city law upheld on appeal in federal court

On Tuesday a federal appeals court upheld a divisive law on banning sanctuary cities in Texas.

On March 13, Attorney General Ken Paxton filed a brief with the U.S. Court of Appeals for the 5th Circuit defending the Texas foster care system from judicially imposed directives that could harm more children than it would help.

The Texas law allows police officers to ask people during routine stops whether they're in the USA legally and threatens sheriffs with jail time for not cooperating with federal immigration authorities. "Law is in effect". "For the following reasons, we uphold the statute in its entirety except for the application of the "endorsement" prohibition ... to elected officials".

The legislation prohibits law enforcement supervisors from preventing their local law enforcement officers from questioning the immigration status of people they detain or arrest.

FBI's Andrew McCabe Might Be Fired Days Before Retirement
It was assumed he'd take extra vacation days until his official retirement date on Sunday. McCabe briefly took over as the FBI's acting director after Trump fired Comey in May.

"While it is disappointing that these three judges of the 5th Circuit could not discern the many inherent and unconstitutional defects in the language and in the enactment of the extremely ill-advised SB 4, we note that this is a panel decision on a preliminary injunction", he said. "Risky criminals shouldn't be allowed back into our communities to possibly commit more crimes". Sessions admonished California politicians for not cooperating with federal authorities on immigration enforcement issues. Around 35 percent of the city's residents are Latinx; under the Obama administration, an escalation in raids and deportations soured relations between community members and law enforcement, something the election of President Trump has not eased.

That came after it was partially blocked by U.S. District Judge Orlando Garcia in San Antonio last summer.

If you're a supporter of so-called sanctuary cities, you were just handed a big defeat by the 5th Circuit Court of appeals. The magistrates put the enfasis on the word "support" and said that punishing this with a fine, imprisonment or dismissal can violate the rights of the authorities to free expression.

The law also requires local law enforcement agencies to comply with detainer requests by Immigration and Customs Enforcement, unless there is proof that the person is a citizen or lawfully in the country. The Fifth Circuit's decision, although frustrating, does not change the fact that we all have rights, the most important thing is the right to remain silent when questioned.by the police regarding their immigration status, "said Andre Segura, legal director of the American Civil Liberties and Rights Union (ACLU) of Texas".
