'Foreign law firms can't practise in India'

The Supreme Court on Tuesday ruled that foreign law firms can not open offices in India or practice in Indian courts, Live Law reported. "In case of a dispute whether a foreign lawyer was limiting himself to "fly in and fly out" on casual basis for the goal of giving legal advice to their clients in India regarding foreign law or their own system of law and on diverse global legal issues or whether in substance he was doing practice which is prohibited can be determined by the Bar Council of India", a bench of Justices Adarsh Kumar Goel and U U Lalit said.

The apex court was hearing a batch of appeals and cross-appeals from the Bar Council and foreign law firms challenging two high court judgments that had held that foreign law firms and lawyers can not practise in India.

The Bombay High Court had in 2009 challenged the RBI's decision to allow foreign law firms such as White & Case, Chadbourne & Parke, and Ashurst to set up liaison offices on Indian soil.

The Court has also asked BCI and the Central Government to frame necessary rules in this regard.

To put the verdict into immediate effect, the bench directed the Bar Council and the Centre to "frame rules regarding participation of foreign law firms in International Commercial Arbitration". "We want foreign lawyers to come so as to not deny the Indian advocates of the same privilege in other countries".

The ruling came from a bench of Justices A K Goel and U U Lalit which heard a batch of appeals against orders of the Bombay and Madras High Courts.

The Supreme Court on Monday sought a response from the Bar Council of India (BCI) on a plea for ban on lawmakers from practising as advocates. It also ruled that Business Process Outsourcing companies working on legal services can operate in India because they are not required to operate under the ambit of the Advocates Act, The Times of India reported.

In the alternative, he has sought for a direction quashing Rule 49 of the Bar Council of India Rules as ultra vires the Constitution and its basic structure, and to permit all Public Servants to practice as Advocates.

The court rejected the contention that the Advocates Act applies only if a person is practicing Indian law.
