India Slaps Google With $21M Abuse Of Dominance Fine

Latest regulatory setback? India's antitrust watchdog has imposed a 1.36B rupees ($21.2M) fine on Google for abusing its market dominance.

However, CCI did not find any contravention in respect of Google's specialised search design (OneBoxes), AdWords, online intermediation and distribution agreements.

Whilst finding Google to have abused its dominant position by engaging in search bias and other practices, the CCI has nonetheless exercised restraint recognising the dynamic nature of online markets and refrained from agreeing with every finding of its investigation arm.

The Commission has ordered Google to deposit the fine within 60 days. In one example, the CCI found that the tech giant deliberately placed its commercial flight search function above competitor websites in order to pocket commission payments. In a statement made in response to the fine, a Google spokesman said, "We have always focused on innovating to support the evolving needs of our users".

Google is in trouble again, this time in India as the country's antitrust watchdog accused the company of abusing its market dominance.

An unnamed Google spokesperson told the Press Trust of India that the company was reviewing the order.

The penalty was calculated at the rate of 5 per cent of the average total revenue that Google generated from the different business operations in the 2013, 2014 and 2015 financial years. "The competitors were denied access to the online search syndication services market due to such a conduct".

While the fine may come as a blow to Google, the size of it pales in comparison with its 2017 Q4 profits of $6.8 billion.

Reacting to the CCI order, a Google spokesperson on Thursday said that it was reviewing the "narrow concerns" identified by the Commission and would assess its next steps.

Friday's ruling follows a similar decision a year ago by the European Union, which issued a record $2.7 billion (€2.4 billion) fine against the internet giant finding the company guilty of skewing search results by favoring its own shopping search service over competitors'. The commission passed the order with a vote of 4-2, with 2 dissenting.
