In a statement released tonight by the presidential office, the president stated that in order to investigate and take actions related to complaints and allegations about the so-called capture of the State (participation of private companies in government efforts) made a decision to establish this commission.

The report recommended that‚ because Madonsela did not have enough funds to finalise the investigation‚ Zuma appoint a commission of inquiry to complete the investigation.

Zuma is appealing this judgement but says in a statement: "I am taking further legal advice on the prosecution of this appeal".

"I am not going to be lured by a red herring".

Zuma has said he will still appeal the high court's ruling regarding its "legality", but was nevertheless setting up the inquiry.

Madonsela said she had clarity on what the terms of reference should be: what she investigated.

The Guptas allegedly exert undue influence on Zuma in the appointment of cabinet ministers and in the awarding of lucrative contracts with state-owned enterprises to the Guptas in what is called "state capture". "It must be properly staffed, fully funded and free from any political inference", DA leader Mmusi Maimane said in a statement.

Her predecessor, Thuli Madonsela, released the State of Capture report on October 14, 2016 - the day Madonsela officially vacated office. "There is no room to expand the commission to include what was never investigated".
