Wesley Mathews Indicted on Capital Murder Charge

The father of the three-year-old Indian girl found dead in a culvert in Texas, has been charged with capital murder by a grand jury, the Dallas District Attorney said in a statement on Friday.

Three year old Sherin, who had developmental disabilities, was reported missing by her adoptive parents, Wesley and Sini Mathews, in October.

Mathews told police that Sherin stifled and hacked and in the long run he felt she had no heartbeat and trusted the youngster had dead. The little girl's body was found there October 22 and her death was ruled a homicide.

The indictment released Friday alleges Mathews caused his daughter's death on October 7 using a deadly weapon that 'is unknown to the grand jury'.

Mathews was indicted on a capital murder charge and a tampering with physical evidence charge. The doctor also said she didn't believe Sini Mathews' assertion that Sherin broke her elbow when her older sister pushed her off the couch.

Mathews had initially told authorities he made Sherin stand outside because she wouldn't drink her milk, and she disappeared.

Mathews is being held at the Dallas County jail on a $1 million bond.

Rafael De La Garza, attorney for Wesley Mathews, told NBC 5 that he does not have a statement at this time. According to the affidavit, Mathews also said "he knew coyotes had been seen in the alley where he left his daughter".

In his initial report to police, Wesley Mathews said he waited several hours to report the girl missing and had done laundry as he waited for her to come home. Her attorney has previously said she played no role in Sherin's death.

Richardson Police Chief Jimmy Spivey said the case has been "very intensive" for his department.

Mathews allegedly said he placed her body in the back of his vehicle with a bag of garbage, drove to a shopping center where he disposed of the garbage, then to a culvert where he hid her body, reports CBS DFW.
