Pentagon knew of lapses reporting crimes to Federal Bureau of Investigation

Following yesterday's tragic events in Texas, the Department of Defense has requested the DoD Inspector General in concert with the Air Force to review the handling of criminal records in the case of former Airman Devin P. Kelley after his 2012 domestic violence convictions.

And the fact that his conviction carried a penalty of 12 months confinement should have also prevented him from buying a gun, according to ATF regulations.

Not only did he choke and kick his wife, pull her hair and punch the child - he was also accused of twice pointing a loaded gun at his spouse, according to records released to the Daily News by the Air Force. He was later on let off the hook with a bad-conduct discharge.

The Pentagon has been failing to disclose domestic violence convictions and warrants by its personnel to the managers of the Federal Bureau of Investigation gun background check database.

The failure to relay the information prevented the entry of his conviction into the federal database that must be checked before someone is able to purchase a firearm.

Because his information wasn't entered, Kelley wasn't flagged.

The Air Force said it is investigating how that happened and why Kelley's fingerprints were never put into the database.

Kelley killed at least 26 people and wounded several others on Sunday when he opened fire at a church service in the small Texas town of only about 600. Kelley pleaded guilty to aggravated assault against the child and assault against his wife. It was clear that the Air Force's oversight apparently allowed the gunman to make the purchase despite the fact that the law had stopped him from doing so. But he didn't tell us an accurate number of domestic violence claims.

The Department of Defense (DOD) said they have launched an investigation into how the criminal records for Devin P. Kelley may have been mishandled.

A dishonorable discharge is considered the most severe classification of punitive military judgments and U.S. federal law prohibits ownership of firearms by those who have been dishonorably discharged.
