The EC ruling comes as a setback for the party's faction led by senior leader Sharad Yadav who is fighting the coming Assembly polls in Gujarat in an alliance with the Congress.

Sharad Yadav, a former President of the JD-U, had broken away from Chief Minister and JD-U President Nitish Kumar after the latter joined the Bharatiya Janata Party (BJP)-led National Democratic Alliance (NDA) in July-August this year.

The Commission has pronounced its final order after rejecting the petition by Mr Vasava.

On the other hand, the counsel for the Nitish's faction advocate Rakesh Dwivedi, contended that the present strength the national council of the Party consists of 195 members as reconstituted on the basis of the organisational elections held in October, 2016.

The JD (U), which is a recognised state party in Bihar, had split when Mr Kumar had chose to walk out of the Grand Alliance in Bihar in which the Rashtriya Janata Dal and the Congress were partners.

The EC has also taken note of it saying "in view of the above urgency in the matter on account of the current general election to the Legislative Assembly of Gujarat, which is already in progress since November 14, the Commission passes the following order in the matter".

Senior leader Sharad Yadav led faction opposed the move and alleged Nitish Kumar of indulging in anti-party activities by going against the decision of the national executive of the party, which had opposed the BJP.

"It has also been clarified by this order that three is no dispute or dissatisfaction in any corner of the party", he added.

"With RJD being run by a strong Yadav family, it would be a natural homecoming for Mr. Sharad Yadav", said an RJD leader. "Reservation is one of the many ways through which we try to achieve that", Kumar, whose recent decision to introduce reservations in outsourced services has been widely talked about, said. "Our battle will continue", Raza said.

He said that the group would anyway contest Gujarat elections under Chhotubhai Vasava's leadership.
