Justice Asif Khosa of SC rescues himself from Hudaibiya Paper Mills reference

In the judgement in that case, Justice Asif Saeed Khosa, who is also heading the bench in this case, had directed NAB to proceed against Finance Minister Ishaq Dar, who was not an accused in the original reference concerning Hudaibiya filed in 2000 as he had been pardoned after signing a confessional statement.

According to details Justice Khosa remarked that his name is being put in the bench by mistake of office.

A three-member Supreme Court (SC) bench that was formed to hear National Accountability Bureau (NAB) appeal to reopen Hudaibiya Papers Mills against Sharif family has dissolved today (Monday).

On Monday, when NAB Special Prosecutor Syed Imran Ali requested Justice Khosa to order the case to be fixed for hearing next week, the judge observed that such a decision was the prerogative of the chief justice. "I wrote 14 paragraphs over Hudaibiya Papers Mills in the April 20 decision".

Following his recusal, the matter will be referred to Chief Justice Mian Saqib Nisar again, who may constitute another bench to hear and decide the appeal.

Justice Khosa also said he had already asked the NAB for an action with regard to Hudaibiya case.

The bench, headed by Justice Khosa and comprising Justice Dost Mohammad Khan and Justice Mazhar Alam Miankhel, was constituted on Friday. NAB has filed a separate application asking the apex court to condone the delay in filing the appeal.

The anti-graft body had submitted that in view of the fact that the JIT which was constituted by the apex court while dealing with the petitions, for probing Panama matter, when collected further incriminating material regarding Hudaibiya Paper Mills, it (NAB) can not be debarred or restrained from proceeding further with the investigation, hence it would be appropriate to set aside the impugned judgment to the extent of re-investigation in order to fortify and corroborate the material collected by the JIT.

Former prime minister Nawaz Sharif, Punjab Chief Minister Shahbaz Sharif, Shamim Akhtar, mother of Nawaz, Shahbaz and the late Abbas Sharif, Maryam Safdar, Hussain Nawaz, Hamza Shahbaz, Hudaibya Paper Mills Ltd, the federal government and others have been named as respondents in the appeal.

The Sharif family had earlier chose to challenge the bench of the Apex court formed for hearing the NAB appeal seeking reopening of the Hudaibiya papers mills reference.

The Hudaibiya Paper Mills is basically about money laundering of Sharif family during 1990s.

Dar turned approver in the case, but later retracted his statement given against the Sharifs claiming it was extracted under duress.

On Dec 3, 2012, the high court had quashed the reference in a unanimous judgement, but the judges disagreed over the permissibility of a NAB reinvestigation.
