Across from White House, Muslims and allies protest travel ban

US District Judge Derrick Watson issued the ruling after the ban on a set of mostly Muslim countries was challenged by the state of Hawaii, which warned that the restrictions would separate families and undermine the recruiting of diverse college students. While US District Judge Theodore Chuang in Maryland, in a ruling filed overnight, said the plaintiffs challenging the policy were likely to succeed in proving that it violated the non-discrimination law "to the extent that it bars entry by immigrants on the basis of nationality".

The new presidential order maintains restrictions on five of the six countries from the original travel ban - Iran, Libya, Somalia, Syria, and Yemen.

The judge's order did not apply to the latest restrictions on travel from North Korea and Venezuela. Rather the bans on both those countries will affect relatively tiny groups compared to the banned Muslim-majority nations.

The decision from Judge Derrick K. Watson in Hawaii is sure to be appealed, but for now, it means that the administration can not restrict the entry of travelers from six of the eight countries that officials said were either unable or unwilling to provide information that the United States wanted to vet their citizens.

Watson's order made a months-long trip through the appellate system to the Supreme Court, which stayed the lion's share of his restraining order, allowing the ban to come into effect for people without a "bone fide relationship" to the United States.

In Hawaii, Watson ruled that Trump's latest travel ban suffered from the same problems as a previous version, also blocked. Both judges refused to delay their orders to give the government a chance to go to a higher court, so it must act very rapidly if it hopes to get an early chance, with permission from a higher court, to enforce the new approach in full.

The Justices reinstated the ban, but carved out an exemption for people with a bona fide relationship with a person or entity in the U.S. The courts have previously examined his campaign statements calling for a total and complete shutdown of Muslims entering the U.S.as evidence that his travel ban was created to discriminate against Muslims rather than protect the nation. Yet, Chuang held that travel ban 3.0 failed to "cure" the "religious animus" behind the earlier travel ban.

In the last week, two federal district-court judges in two different federal circuits have issued new injunctions against the Trump administration's latest "travel ban".

Watson tore into the government's defense of the travel ban. "And so it goes with EO-3".

The administration vowed to keep fighting, and the case could again reach the U.S. Supreme Court, which has so far appeared more receptive than lower-court judges to Trump's efforts to curtail immigration. This was a telling indication that the first part of the Muslim ban is being viewed by the Supreme Court Justices with considerably greater constitutional skepticism than the second part.

The administration argued that the statements couldn't be considered once Trump took office and that courts were bound by law to confine their analysis of his orders to the contents of the document. Then the Supreme Court rectified this judicial disorder.
