SCOTUS Sides With Trump on Travel Ban

The Supreme Court agreed with the Trump administration Tuesday and put on hold a lower-court decision that would have allowed more refugees to enter the country.

The travel ban, which bars refugees from six Muslim countries from entering the US, was amended last week due to a federal appeals court order and following the current US Supreme Court ruling, the ban has returned to its original condition.

On Tuesday, the Supreme Court sided with the administration in continuing to ban nearly all refugees from entering before the court takes up the full Muslim travel ban in October.

The Supreme Court ruling gives Trump a partial victory as the high court prepares for a key hearing on the constitutionality of Trump's controversial executive order in October. The Justice Department this week asked for an emergency ruling on the Ninth Circuit's decision, but only as it applied to refugees with formal assurances. The 90-day travel ban lapses end of September and the 120-day refugee ban will expire at least a month later. The affected countries are Iran, Libya, Somalia, Sudan, Syria and Yemen.

The appeals court said the government offered no persuasive reason for making that distinction.

The latest court actions are part of a complicated legal battle that began in January when President Trump issued his first version of an entry ban. The court rejected the government's claim that a "close familial relationship" was limited only to members of a nuclear family (plus in-laws) as an "unreasonabl [e]" and "artificially narrow interpretation" of the Supreme Court's ruling. "We will continue to vigorously defend the order leading up to next month's oral argument in the Supreme Court".

That includes grandparents, grandchildren, brothers-in-law, sisters-in-law, aunts, uncles, nieces, nephews and cousins to a list that already included a parent, spouse, fiance, son, daughter, son-in-law, daughter-in-law or sibling already in the U.S.

The Justice Department appealed, and the full Supreme Court on Tuesday sided with the administration in a one-sentence order. The justices are expected to hear arguments [docket, PDF] related to the case on October 10.

The 9th Circuit's order requires the administration to admit refugees contracting with resettlement agencies beginning Tuesday.
