Judge denies National Football League attempts to stay Ezekiel Elliott injunction

He was limited to a career-low 8 rushing yards on 9 attempts, the Dallas Cowboys got blown out by the Denver Broncos and the former Ohio State running back is facing criticism for giving up on a play.

The NFL took the case to the 5 Circuit last Friday and filed a brief with the court on Monday asking it not only rule on the emergency stay, but also expedite the appeal of the preliminary injunction and hear briefs on both issues simultaneously in hopes resolving the issue of Elliott's status in a matter of days.

The NFL has asked for a response on the stay from the 5th Circuit by 10 a.m. Tuesday or September 26 at the latest.

U.S. District Court Judge Amos Mazzant III blocked the league's request Monday as he continues to review the merits of a petition by the NFL Players Association to have Elliott's ban dissolved.

The NFL Players Association appealed his suspension on August 15. Mazzant writes "In light of the background, the Court found that the denial of Commissioner (Roger) Goodell and (Tiffany ) Thompson's testimony were gross evidentiary errors that so affected the rights of the NFLPA and Elliott, such that they were deprived of a fair hearing and it constituted misconduct by (arbitrator Harold) Henderson".

Last Friday, the National Football League filed an emergency motion with the 5th Circuit seeking a stay of the injunction ordered by Mazzant.

Hall of Fame running back LaDainian Tomlinson, pointing out his sideline demeanor, said on NFL Network's "NFL GameDay Prime" that Elliott "absolutely quit on his team" Sunday. The long and short of it is that another court has determined that Elliott will be allowed to play for the foreseeable future.

The NFL argues Mazzant's ruling interferes with a legally-binding labor deal that has been approved by the league and the union.
