Ayodhya title dispute hearings from December 5

Judges today said they will start final hearings in the case on December 5 and have asked for all relevant documents to be translated by the Uttar Pradesh government into English within the next three months.

The Bench said other documents in the form of 533 exhibits cited in the High Court's verdict will have to be translated by the parties which choose to rely on them. The Centre sought a "larger debate" on Article 35A, as advocate general K K Venugopal suggested in court, and the matter is with a three-judge bench with possible disposal by September first week.

The apex court, after an intense deliberation for more than one-and-half-hours, reached a consensus on commencement of the hearing on the cross-appeals filed against the 2010 judgement of the Allahabad High Court.

The 30-page affidavit assumes significance as it has been filed within few days of the apex court agreeing to fast track the hearing on a batch of appeals challenging the Allahabad High Court verdict on the land dispute in the case.

Countering the prevalent perception that the mosque was built by Mughal emperor Babur, the board said it was actually constructed by his minister Abdul Mir Baqi, a Shia Muslim, out of his own funds.

The high court's Lucknow bench had said the disputed 2.77 acre area at Ayodhya should be partitioned equally among three parties - the Sunni Waqf Board, the Nirmohi Akhara and Ram Lalla. Reportedly, the board had earlier chose to become a party in ongoing litigations in relation to the Ramjanmabhoomi - Babri Masjid dispute.

However, its intervention has been opposed by the All India Sunni Waqf Board which claimed that judicial adjudication between the two sects had already been done in 1946 by declaring the mosque, which was demolished on 6 December, 1992, as that belonging to the Sunnis. The board told Supreme Court that the documents are in 5 different languages and require time to be translated.

The contested site, in Uttar Pradesh's Ayodhya city, was the scene of a searing act of religious violence in 1992 when Hindu activists tore down an ancient mosque, known as the Babri Masjid, on the property. The Sunni Waqf Board tells Supreme Court that the translation of historic documents is not complete yet. The two boards representing two groups of muslim community are all set to fight out their case in court as Shia board has already blamed its rival for opposing amicable settlement of Ram Janam Bhoomi-Babri Masjid row.
