Maryland, DC sue Trump, accuse president of profiting from office

A lawsuit filed Monday in federal court says Trump is violating the Constitution's Foreign Emoluments Clause, which prohibits the president from accepting payments from foreign governments without the consent of Congress.

Maryland Attorney General Brian Frosh and his D.C. counterpart, Karl Racine, also vowed to wrest from Trump financial and tax records that he has thus far refused to reveal so they can find out whether he is cashing in on the presidency.

The lawsuit claims foreign payments to Trump's businesses violate the US Constitution's domestic emoluments clause.

The lawsuit, first reported by The Washington Post, comes months after state lawmakers in Maryland gave their attorney general the authority to bypass the governor in suing the federal government.

The attorneys general also said states that provide zoning variances or tax breaks to a Trump business project could win favor at the White House, harming those that do not.

The attorney generals argue that the constitutional clause that deals with this issue intends to limit the potential for corrupting influences from foreign governments.

As a result, the district is in a "unique position" to file legal claims over the emoluments clause, Racine said.

"The President's conflict of interests threaten our country". The lawsuit cites Trump's leases, properties and other business "entanglements" around the world as the reason for the suit, saying those posed a conflict of interest under a clause of the Constitution.

The Justice Department asked a federal judge to dismiss the case on Friday. For example, the President continues to own luxury hotel and resort properties - including a new one just down the street from the White House - catering to foreign and state government business.

The lawsuit also focuses on the fact Mr Trump chose to retain ownership of his company when he became President.

"Again, the reason why we're here is because the President of the United States, in a wholly unprecedented fashion, has made a decision to maintain a sprawling worldwide business empire that accepts money without account from foreign governments", Mr Racine said. "But the most salient factor is that when the president is subject to foreign influence, we have to be concerned about whether the actions he's taking - both at home and overseas - are the result of payments that he is receiving at the Trump Hotel and other businesses", Frosh said. The domestic emoluments clause forbids the president from receiving any other "emolument" while he's in office, generally defined as a payment or other financial benefit.

Both Attorneys General are Democrats, and Trump's Press Secretary has accused them of partisanship.

Since then, a restaurant group and two individuals in the hotel industry joined as plaintiffs.

He told the company in a letter last month that Trump should either divest his ownership or get permission from Congress to accept all sources of foreign money if it's too hard to identify those payments.
