Juror: 2 holdouts in Bill Cosby's trial refused to convict

Judge Steven O'Neill said Tuesday that he promised jurors privacy when they were selected.

The jury deadlocked after 30 hours of deliberations and there was no movement after that, the juror said, adding that the tension was heightened by the size of the tiny deliberation room.

Presiding Judge Steven O'Neill told jurors they didn't need to discuss the case.

Steele argued against releasing the names, and Cosby's lawyer Brian McMonagle wrote in a letter to O'Neill that making juror names public "could prevent Mr. Cosby from getting a fair trial in the future".

Jurors were selected in Allegheny County because Cosby's attorneys argued that pretrial publicity would make it hard to find impartial jury candidates in Montgomery County, where Cosby lives. Cosby, 79, is charged with three felony counts of aggravated indecent assault in connection with allegations he drugged and sexually assaulted Andrea Constand, the former director of women's basketball operations at Temple University, at his Cheltenham mansion in mid-January 2004.

"Jurors shall not disclose anything said or done in the jury room by any of their fellow jurors that may indicate his or her thoughts or opinions".

Lawyers for more than a dozen media outlets, including The Associated Press and the major TV networks, argued that juror interviews would do little to exacerbate the situation.

Complicating matters is the fact that Cosby's trial ended Saturday in a mistrial and prosecutors said they will retry him as soon as this year.

Throughout the trial, Judge O'Neill had been mindful of the jurors, who were chosen from Allegheny County, some 300 miles away, to avoid the influence of pretrial publicity.

"It was the craziest, eeriest bus ride I've ever taken", said McCloskey, 43.

"If a juror were to be asked about deliberations and there were to be press coverage about those deliberations, I don't see what marginal difference that would make given that the prosecution and the defense have spoken publicly about this case, including evidence that was not heard in court", he said.

Steele argued on Tuesday that although jurors may choose to come forward to the media of their own volition that should be their choice.

Cosby still faces several civil cases from a few of the almost 60 women who have come forward in recent years, accusing him of decades-old sexual assault. He has denied attacking her and maintained throughout his trial that their sexual liaison was consensual.

One key area will be the admission of witnesses alleging "prior bad acts" - that is, testimony from women who've accused Cosby of similar acts but who are unconnected to the Constand case.

The Associated Press tried contacting jurors for comment Wednesday but was not immediately able to reach any of them. They are interested in finding out how close the jury came to reaching a verdict.
