Ex-president of Penn State going to jail in sex abuse case

Prosecutors said he should receive a penalty in the upper part of the allowable range for the conviction, which carries a maximum sentence of one year. His lawyers are pushing for probation. Friday, Spanier indicated he will appeal the conviction.

All three will serve additional periods of house arrest once they are released from prison - 2-10 months for Spanier, 4-21 months for Schultz and 4-20 months for Curley.

Paterno “could have made that phone call without so much as getting his hands dirty, ” Boccabella said. They also noted that Spanier showed a "stunning lack of remorse of his victims" and said he chose "to protect his personal reputation and that of the university instead of the welfare of children".

They did not recommend a specific sentence, but agreed that Curley should be allowed to serve any custodial sentence at home because of his health. But, in the filing, they wrote that Curley's forgetfulness during his testimony in Spanier's trial wasn't credible, and that his memory was "markedly more clear" in his private statement to investigators a week before he testified. But they say Curley's forgetfulness during his testimony wasn't credible.

Mike McQueary, a graduate coaching assistant, told administrators that he saw Sandusky molesting a boy in a football team shower in 2001.

Sandusky was not arrested until 2011, after a prosecutor got an anonymous email tip. Spanier was convicted of hushing up suspected child sex abuse by Jerry Sandusky in 2001, a decade before Sandusky was arrested for the serial molestation of young boys. They also criticized Schultz's refusal to acknowledge the sexual nature of the 2001 complaint about Sandusky.

The administrators were charged for not properly reporting the incident.

The university has paid almost $250 million in settlements, legal bills, fines, public relations and other costs stemming from the scandal. Paterno's son, Jay Paterno, said Friday that his father had followed the law in alerting Curley and Schultz, and that prosecutors have no evidence that Paterno tried to protect Sandusky.

He was wrong. Four days after Sandusky's arrest on November 5, 2011, Spanier was sacked, along with legendary coach Joe Paterno. Instead, Boccabella noted, Spanier, Curley and Schultz made a decision to do nothing.

Spanier has said he didn't know Sandusky was a threat to children, but after he was found guilty, he said he regretted that "I didn't intervene more forcefully".
