Flynn lawyers say will not honor subpoena for Russia-related documents

The Senate's intelligence committee had asked Flynn - President Trump's former national security adviser - in April to turn over documents relevant to the committee's investigation into Trump campaign associates' connections to Russian Federation. "General Flynn's attorneys have not yet indicated their intentions regarding the Senate Intelligence Committee's subpoena", he said. Burr told reporters Thursday that Flynn's lawyer informed the panel he will not abide by a subpoena for private documents. "Consistent with the committee's position since the beginning of or investigation, I welcome their willingness to cooperate", Burr said.

The district court route would entail the Senate passing a resolution authorizing civil action that could lead to Flynn being charged with contempt of court.

But following his departure, a lawyer for Flynn said that the retired lieutenant general would testify in front of the Senate committee in exchange for "assurances against unfair prosecution".

The letters asked for the men to list any meetings they might have had with Russian officials between June 16, 2015 - the day Trump formally launched his presidential campaign - and Trump's inauguration on January 20, as well as records of any communications during that period.

Flynn, a retired Army lieutenant general, was sacked from his position as Trump's national security adviser in February.

Just 29% of Americans approve of Trump's decision to fire Comey
One source says Rosenstein isn't inclined to make a change unless the FBI investigation appears to be imperiled. According to press reports, Pence was aware that Trump wanted to fire Comey the week before it happened.

The Senate Intelligence Committee's counterterrorism probe took on added significance after President Donald Trump dismissed FBI Director James Comey last week amid allegations of Russian meddling in the 2016 USA presidential election.

But The New York Times reported Wednesday that Flynn told Trump's transition team that his Turkish connection was under federal investigation.

Flynn, the former national security adviser, was sacked in February for misleading Vice President Mike Pence about the contents of a December phone call with Russian Ambassador Sergey Kislyak. Yet he still emerged as the newly sworn-in president's national security adviser.

A White House aide told NBC News Vice President Mike Pence "stands by his comments in March upon first hearing the news" about Flynn's ties to Turkey. Under 2 U.S.C. § 194, the committee and full chamber of Congress must certify the contempt referral, which is sent to a U.S. Attorney 'whose duty it shall be to bring the matter before the grand jury for its action.' Notably, a criminal contempt charge was certified against Attorney General Eric Holder, but the U.S. Attorney refused to bring it before the grand jury.

Flynn has been under scrutiny from the Justice Department since at least November 30, when the department's Foreign Agent Registration Act unit sent him a letter questioning whether he needed to register as a foreign agent for lobbying work he performed for a Turkish businessman. As of last week, the committee had received two responses, according to Burr. The U.S. has rebuffed those calls.
