The EPA said around 104,000 Jeep Grand Cherokee SUVs and Ram pickups from the 2014-2016 model years are affected.

After months of negotiations with regulations agencies, Fiat Chrysler Automobiles has formally put forward an application to certify its 2017 model-year diesels.

Fiat Chrysler Automobiles NV FCHA.MI plans to update software that it expects will resolve the concerns of US regulators about excess emissions in 104,000 older diesels, the Italian-American automaker said on Friday.

Since the beginning, FCA has been clear in saying that the software is not a "defeat device", or there to intentionally fool regulators.

FCA says it will modify its 2014-2016 Jeep Grand Cherokees and Ram 1500 diesel vehicles with calibrations to its emissions software.

According to the reports, the Justice Department is allegedly planning to file a case against Fiat Chrysler in connection with claims of the company selling more than 100,000 vehicles that emit excessive diesel emissions.

"The filing is the result of many months of close collaboration between FCA US and EPA and CARB, including extensive testing of the vehicles, to clarify issues related to the company's emissions control technology", the company wrote in a statement. Gasoline versions of both models are now on sale, but the diesels (or any vehicle, for that matter) can't be sold in the US without emissions certification, and it's unclear how long the EPA will take to approve or reject FCA's application.

Approval might also signal a positive effort to avoid the kind of scandal that roiled Volkswagen over diesel emissions cheating.

In addition to the fines, the beleaguered German automaker has agreed to pay $14.7 billion to fix or buy back about 475,000 rigged 2-liter diesel vehicles and $1.2 billion on 80,000 3-liter diesels. Governments the world over have started investigations into Volkswagen and other diesel manufacturers that might be cheating on tests.

The emission-cheating scheme has cost Volkswagen more than $20 billion in fines and settlements, in addition to goodwill among some US drivers.

The software update would begin rolling out once the Environmental Protection Agency and California Air Resources Board approved, Fiat Chrysler said. FCA says the update will reduce emissions without impacting engine performance or fuel efficiency.

The U.S. Justice Department prepares to submit a civil lawsuit against Fiat Chrysler Automobiles over excess diesel emissions as early as this week if no arrangement is reached with the Italian-American auto manufacturer, 2 sources briefed on the matter stated on Wednesday.
