Arkansas vows to keep pushing for executions despite setback

A federal judge' ruled on 15 April ruling stopped the state from executing six of the inmates with a preliminary injunction handed down in response to a lawsuit filed by the inmates, who claimed the executions were unconstitutional due to their rapid pace and also the ineffectiveness of the anaesthetic Midazolam.

Convicted murderer Ledell Lee, 51, appeared with attorney Lee Short of North Little Rock on Tuesday afternoon before Judge Herbert Wright in Pulaski County Circuit Court for a motion hearing seeking additional examination of hair and blood samples.

An eighth inmate, Jason McGehee, previously won a stay from a federal judge regarding his clemency schedule, and Arkansas has not appealed that ruling.

The state ruling also applied to Bruce Ward, an Arkansas prisoner whose execution, originally scheduled for Monday, was already the subject of an unrelated stay.

A rally, at which Bishop Taylor was present, was held outside the Arkansas State Capitol April 14 calling for the executions to be stopped.

McKesson contends that the state failed to disclose the vecuronium bromide it purchased would be used in its three-drug lethal injection protocol.

Arkansas planned to execute two men per day starting after Easter Sunday on April 17, April 20, April 24 and April 27. One of them, the sedative midazolam, has been associated with botched executions in Alabama, Arizona, Ohio and Oklahoma. But the Republican governor says he was heartened by other court rulings Monday that could pave the way for Arkansas to execute several more inmates before the end of April.

"The schedule of executions was not set by the demands of justice, but by the arbitrary politics of punishment", he said. In a separate decision, the 8th U.S. Circuit Court of Appeals vacated a decision made over the weekend by a federal district judge that halted a total of eight executions over an 11-day period.

In a one-paragraph order released in the early morning hours Tuesday, the nation's highest court declined to lift Davis' stay of execution granted by the Arkansas Supreme Court.

Hutchinson and state Attorney General Leslie Rutledge have been pushing to carry out the executions anyway.

"It is understandable that the inmates are taking every step possible to avoid the sentence of the jury; however, it is the court's responsibility to administer justice and bring conclusion to litigation", Gov. Asa Hutchinson said Tuesday in an emailed statement.

A judge in Little Rock has rejected a request for additional DNA testing in the murder case of Arkansas inmate Ledell Lee, who's scheduled for execution Thursday night.

Federal and state courts have stayed the executions of two other inmates along with Davis. The issue in that case is about the sedative midazolam and whether its use in executions could violate inmates' Constitutional rights.

McKesson filed a complaint April 18 in Pulaski County Circuit Court seeking a restraining order and injunction to prevent the vecuronium it supplied from being used "for something other than a legitimate medical objective".

The state and death-row inmates engaged in legal battles over whether or not the executions would take place in that 11-day window.

The judge in question, Wendell Griffen, has since been removed from all cases involving the death penalty, under an order from the Arkansas Supreme Court, the Arkansas Democrat-Gazette reports.

The state has appealed both rulings and asked the higher courts to work quickly to review the decisions.

At a federal court hearing last week, prison officials testified that they have no new source for the sedative, which is meant to mask the effects of drugs that will shut down the inmates' lungs and hearts.
